Castle Doctrine In California

Castle doctrine states that a person‘s home is their castle, and that if someone enters their home uninvited, it can be assumed that the resident was in a reasonable fear of the loss of life or great bodily harm. Under the right circumstances, the person reciting at home can defend themselves with lethal force. In California, castle doctrine exists. We have had several court cases that have limited castle doctrine to the interior of a home. In addition, the person defending their home cannot be involved in mutual combat or cannot be the aggressor of an incident.
